HAIRCUT NOW TERMS OF SERVICE

1. Introduction
Haircut Now (“Company,” “we,” “us,” or “our”) operates a multi-service platform that includes:
A same-day haircut marketplace connecting clients (“Clients”) with independent barbers (“Barbers”), and
A public online barber directory (“Directory”) featuring free and paid listings.
By accessing or using our website, mobile applications, marketplace, or directory (collectively, the “Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. Nature of Services
Haircut Now does not provide haircutting, grooming, or personal care services. All services are performed by independent Barbers. Haircut Now does not control, supervise, or direct the services provided by Barbers and is not responsible for service quality, outcomes, or safety.
The Directory is an advertising and discovery service only and does not guarantee leads, bookings, or business results.
3. Independent Contractor Status
All Barbers using the Platform or listed in the Directory operate as independent contractors and not as employees, partners, agents, or representatives of Haircut Now.
4. Client Terms of Use
4.1 Booking & Payments
Clients pay a deposit through the Platform at the time of booking.
The deposit is deducted from the total service cost.
All remaining fees are paid directly to the Barber at the appointment.
Off-platform deposit arrangements are prohibited.
4.2 Cancellations & Refunds
Clients may cancel up to 1 hour before the appointment for a refund of the deposit.
Late cancellations and no-shows result in forfeiture of the deposit.
Service quality refunds must be handled directly with the Barber. Haircut Now may facilitate communication but is not responsible for outcomes.
4.3 Client Responsibilities
Clients agree to arrive on time, act respectfully, and refrain from harassment, discrimination, or misconduct. Violations may result in suspension or termination.
5. Barber Marketplace Terms
5.1 Licensed Commercial Operation
Barbers must operate from licensed commercial establishments only (barbershops, salons, or suites). Home-based or mobile services are prohibited.
5.2 Adherence to Platform Pricing
Barbers must honor the prices displayed on the Platform and may not pass referral fees to Clients or add unauthorized charges.
5.3 Performance Standards
Haircut Now reserves the right to remove Barbers with repeated negative reviews, complaints, or policy violations.
6. Directory Listings
6.1 Eligibility
The Directory features:
Individual Barbers
Barbershops
Salons
Listings must be claimed before becoming active unless originally created by the business owner.
6.2 Public Visibility
All Directory listings are publicly visible and may appear in search engines.
6.3 Accuracy of Information
Listing owners are solely responsible for maintaining accurate, current, and truthful information. Haircut Now is not responsible for errors, omissions, or outdated listings.
7. Claiming & Verification
Listing claims are automatically verified, but may later be manually reviewed.
If fraud or misrepresentation is discovered, Haircut Now may deny, revoke, or remove the listing without refund.
Proof of identity or ownership may be required if verification cannot be conclusively determined.
Haircut Now reserves full editorial control over all directory content.
8. Directory Subscriptions, Stripe Payments & Billing Compliance
8.1 Payment Processing (Stripe)
All Directory subscription payments and any Platform-related online payments are processed securely by Stripe, Inc. (“Stripe”), a third-party payment processor.
By purchasing a subscription or making any payment through Haircut Now, you agree to be bound by:
These Terms of Service, and
Stripe’s Terms of Service and Privacy Policy.
Haircut Now does not store full credit card numbers and is not responsible for errors, service interruptions, or security breaches that originate from Stripe.
Additional Payment Processors (PayPal)
In addition to Stripe, Haircut Now may allow payments to be processed through PayPal. By choosing PayPal as your payment method, you agree to be bound by PayPal’s User Agreement and Privacy Policy.
Haircut Now does not store PayPal login credentials and is not responsible for PayPal system outages, processing delays, or security incidents originating from PayPal.
Additional Payment Processor (PayPal)
Haircut Now also allows payments to be processed through PayPal for both one-time transactions and recurring subscription charges. By selecting PayPal as your payment method, you agree to be bound by PayPal’s User Agreement and Privacy Policy.
For recurring PayPal subscriptions, you authorize Haircut Now and PayPal to automatically charge your PayPal account for each billing cycle until you cancel in accordance with these Terms.
Haircut Now does not store PayPal login credentials and is not responsible for PayPal system outages, processing delays, account limitations, or security incidents originating from PayPal.
8.2 Authorization to Charge
By subscribing to any Directory plan, you expressly authorize Haircut Now and Stripe to:
Charge your selected payment method immediately upon purchase, and
Automatically charge your payment method for each renewal period until cancellation.
This authorization remains in effect until you cancel your subscription.
8.3 Auto-Renewal Disclosure
All Directory subscriptions:
Automatically renew by default
Renew at the same billing cycle (monthly or annual) unless canceled before renewal
Are billed in advance of each term
Generate a renewal notice 30 days prior to billing
You are solely responsible for maintaining accurate and valid payment information.
8.4 No Refunds & End-of-Term Cancellation
ALL DIRECTORY SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE, including:
Monthly subscriptions
Annual subscriptions
If you cancel your subscription:
Your listing remains active until the end of the current billing term
No prorated refunds or credits are issued
You retain full access and visibility until expiration
This no-refund policy applies regardless of whether payment is made via Stripe, PayPal, or any other approved payment processor.

8.5 Failed Payments & Reattempts
If a subscription payment fails:
Stripe will automatically attempt to reprocess the payment
Continued failure may result in:
Downgrade of your listing
Temporary suspension
Permanent removal
Haircut Now is not required to provide service without successful payment.
8.6 Chargebacks & Payment Disputes
By purchasing a subscription, you agree that:
Chargebacks will be considered a billing dispute
Excessive chargebacks may lead to immediate account or listing termination

Fraudulent chargebacks may be reported to Stripe and applicable financial institutions.
Disputes initiated through PayPal are subject to PayPal’s resolution process. Excessive or fraudulent PayPal disputes may result in immediate suspension or termination of your Directory listing without refund.

8.7 Pricing Changes
Haircut Now reserves the right to modify subscription pricing at any time.
Price changes apply only to future billing cycles with advance notice provided.
8.8 Taxes
You are responsible for all applicable sales, use, VAT, or digital service taxes imposed by taxing authorities. Stripe may calculate and collect these taxes automatically where required by law.
8.9 Payment Method Updates
Stripe may automatically update stored payment credentials from your card issuer (e.g., expiration updates), and you authorize Stripe to continue charging updated credentials when provided by your bank.
8.10 Marketplace Deposit Compliance
Client booking deposits collected through the Platform:
Are processed via Stripe
Are deducted from total service cost
Do not constitute full payment for barber services
Are subject to your existing cancellation rules
Haircut Now does not guarantee Barber payments outside of the deposit collected.
9. Fees & Marketplace Payments
Haircut Now collects only the booking deposit.
Barbers receive all remaining service fees directly from Clients.
The deposit may include a referral fee retained by Haircut Now.
Haircut Now does not guarantee off-platform payments.
10. Ratings, Reviews & Directory Feedback
Clients may leave reviews on both marketplace and directory listings.
Reviews must be accurate, lawful, and non-defamatory.
Haircut Now may moderate or remove reviews at its discretion.
11. Enforcement Actions
Haircut Now may, at its sole discretion and without refund:
Remove listings
Downgrade subscriptions
Suspend accounts
Permanently ban users
For violations including fraud, abuse, misrepresentation, or misuse of the Platform.
12. Disputes & Resolution
Haircut Now provides limited dispute facilitation only. We do not guarantee resolution and are not a party to Client-Barber disputes.
13. Limitation of Liability
To the fullest extent permitted by law, Haircut Now is not liable for:
Service quality or safety
Directory performance, views, or lead generation
Financial losses, cancellations, disputes, or no-shows
Reliance on profiles, listings, or reviews
All use of the Platform is at your own risk.
14. Arbitration & Class Action Waiver
All disputes arising from these Terms shall be resolved through binding arbitration, not in court.
You waive the right to participate in any class action lawsuit against Haircut Now.
15. Modification of Terms
Haircut Now may update these Terms at any time. Continued use of the Platform constitutes acceptance of the changes.
16. Termination
Haircut Now may suspend or terminate any account or listing at any time for violations of these Terms.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.
