Haircut Now Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the websites, mobile applications, web applications, marketplace services, booking services, business-management tools, digital products, subscriptions, and other services operated by Haircut Now Inc. (“Haircut Now,” “we,” “us,” or “our”).
Haircut Now Inc. is a Delaware corporation.
Please read these Terms carefully. By accessing, registering for, purchasing, subscribing to, or using any Haircut Now Service, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Services.
1. About Haircut Now and the Services
1.1 Haircut Now Services
Haircut Now operates a technology platform serving clients, barbers, beauty professionals, shops, salons, suite owners, independent professionals, renters, managers, and other businesses.
Our Services may include:
HaircutNow.com and related websites
Haircut Now client applications
Haircut Now Biz
Haircut Now Shops
Haircut Now Marketplace and business directory
Same-Day haircut requests
Appointment and booking services
Digital Barber Card
Walk-In Manager
Booth Rental Manager
Shop booking and management products
Subscription products
Business software and operational tools
Other Haircut Now products and services introduced from time to time
Collectively, these are referred to as the “Services.”
Some Services may be available only to particular account types, subscription plans, geographic areas, devices, shops, or professionals.
Features may differ between free and paid accounts.
1.2 Nature of the Haircut Now Platform
Haircut Now is primarily a technology provider.
Unless expressly stated otherwise, Haircut Now:
Does not provide haircutting, barbering, cosmetology, grooming, beauty, or personal-care services
Does not employ the independent professionals listed or operating through the platform
Does not own or operate third-party barbershops, salons, suites, or other businesses appearing on the platform
Does not supervise or control the manner in which independent professionals perform services
Is not the landlord, tenant, employer, or renter in booth-rental arrangements managed through Booth Rental Manager
Is not a party to contracts between independent shops and their customers, workers, renters, or service providers unless expressly stated otherwise
Haircut Now provides technology that allows users to discover businesses, advertise services, manage operations, communicate, book appointments, manage walk-ins, manage rental records, and perform other business activities.
2. Eligibility, Accounts, and Permissions
2.1 Eligibility
You must be legally capable of entering into a binding agreement to create a business, barber, shop-owner, manager, renter, vendor, or paid Haircut Now account.
Business users represent that they have authority to act on behalf of any business they register or manage.
A parent, guardian, or responsible adult may use Haircut Now to arrange services for a minor.
Users may not create accounts using false identities or impersonate another person or business.
2.2 Accounts
Certain Services require an account.
You agree to:
Provide accurate information
Keep your information reasonably current
Maintain the security of your credentials
Use only accounts you are authorized to access
Notify Haircut Now if you believe your account has been compromised
Accept responsibility for activity occurring through your account when caused by your failure to safeguard your credentials
Different Haircut Now products may use different authentication methods, including:
Email and password
Telephone authentication
Verification codes
Single sign-on
Social authentication
Other approved authentication systems
Haircut Now may link account identities across Services when appropriate to provide unified access, subscriptions, listings, entitlements, or security.
You may not sell, transfer, lease, or provide unauthorized access to your Haircut Now account.
2.3 User Roles and Permissions
Haircut Now Services may support different user roles, including:
Client
Barber or professional
Shop owner
Manager
Team member
Booth or suite renter
Business administrator
Vendor
Other authorized roles
Features and data access may depend on the role assigned to a user.
Shop owners and authorized administrators may grant managers or other users permission to access certain shop information.
Users must not access information or functionality outside the permissions granted to them.
Haircut Now may modify, limit, or revoke permissions when necessary for security, account integrity, or proper operation of the Services.
2.4 Shop Owners, Managers, and Authorized Users
A shop owner may authorize managers or other users to access shop-management functionality.
The account owner is responsible for granting appropriate permissions.
Authorized users may be able to perform actions affecting:
Walk-in activity
Staff availability
Booth-rental records
Payments
Customer records
Shop settings
Team relationships
Other operational information
Users must not access or modify shop information without authorization.
A shop owner is responsible for promptly removing access when a manager, employee, contractor, or renter is no longer authorized.
3. Independent Professionals and Businesses
3.1 Independent Status
Barbers, stylists, shops, salons, suite operators, and other professionals using Haircut Now generally operate independently of Haircut Now.
They are responsible for:
Licenses and professional credentials required by law
Compliance with health and safety requirements
Insurance
Taxes
Business permits
Prices and services offered, except where a particular Haircut Now program establishes specific requirements
Customer service
Quality of professional services
Workplace conditions
Employment relationships
Booth or suite rental relationships
Compliance with applicable local, state, and federal law
Use of Haircut Now does not create an employment, franchise, partnership, agency, joint-venture, or fiduciary relationship between Haircut Now and a participating professional or business.
3.2 Professional and Business Conduct
Professionals and businesses must use Haircut Now in a professional and lawful manner.
Haircut Now may restrict participation for conduct including:
Fraud
Misrepresentation
Repeated failure to honor confirmed services
Safety complaints
Abuse of customers
Manipulation of reviews
Misuse of customer information
Unauthorized charges
Account sharing
False credentials
Material violation of Haircut Now program rules
3.3 Professional Services Disclaimer
Haircut Now does not verify every professional license, credential, insurance policy, or qualification unless a particular program expressly states that verification is performed.
Clients are responsible for deciding whether a professional or business meets their needs.
Haircut Now does not guarantee:
Service quality
Safety
Technique
Results
Sanitation
Licensing status
Professional conduct
Any dispute concerning the actual performance of barbering, beauty, grooming, or related services is generally between the client and the service provider.
4. Marketplace, Listings, and Public Profiles
4.1 Haircut Now Marketplace and Directory
Haircut Now may provide public listings for individual professionals, shops, salons, suites, and other eligible businesses.
Listings may include:
Name
Business information
Contact information
Location
Services
Prices
Business hours
Photographs
Reviews
Booking availability
Same-Day availability
Other professional information
Haircut Now does not guarantee:
Search-engine rankings
Marketplace ranking
Number of impressions
Leads
Calls
Appointments
Clients
Revenue
Customer retention
Business results
Free and paid listings may include different functionality.
Haircut Now may change listing features, ranking factors, presentation, categories, or availability as the platform evolves.
4.2 Claiming and Verifying Listings
Haircut Now may create or maintain listings based on information supplied by users, businesses, partners, public sources, or other lawful sources.
A professional or business may be required to claim a listing before gaining administrative control over it.
Haircut Now may use automated or manual verification.
We may request reasonable evidence of:
Identity
Employment or affiliation
Business ownership
Business authorization
Telephone ownership
Email ownership
Other information needed to validate a claim
Haircut Now may reject, revoke, suspend, merge, correct, or otherwise modify a listing where we reasonably believe that information is fraudulent, duplicative, misleading, inaccurate, unauthorized, abusive, or in violation of these Terms.
4.3 Listing Accuracy
Listing owners are responsible for maintaining accurate information.
Users may not knowingly publish false or misleading information regarding:
Identity
Location
Credentials
Services
Prices
Availability
Business ownership
Shop affiliation
Photographs
Reviews
Booking links
Other material business information
Haircut Now may correct obvious errors or remove inaccurate content.
4.4 Public Information
Marketplace listings, Digital Barber Cards, business profiles, reviews, and similar public-facing features are intended to be publicly accessible.
Information published through these features may be:
Viewed by anyone
Indexed by search engines
Shared by users
Saved by clients
Accessed through QR codes
Added to contact applications
Shared outside Haircut Now
Users should not publish information through public profile fields that they do not want publicly available.
4.5 Digital Barber Card
Digital Barber Card allows eligible professionals to create a digital business card or professional profile.
Depending on the product level, functionality may include:
Contact information
Profile information
Services
Specialties
Photographs
Social-media links
Booking links
QR codes
Contact-saving functionality
Marketplace integration
Other features
The card owner is responsible for information published on the card.
Haircut Now does not guarantee that every device, wallet application, contact application, browser, social platform, or third-party application will support every card feature.
Digital Barber Card functionality may differ between Basic, Pro, promotional, bundled, or future versions of the product.
5. Appointments, Same-Day, and Client Services
5.1 Appointment Booking
Haircut Now may allow clients to schedule appointments with participating professionals or businesses.
The professional or business remains responsible for:
Providing the service
Maintaining availability
Honoring confirmed appointments
Setting or maintaining accurate prices
Communicating material changes
Complying with licensing and safety laws
Establishing any permitted business-specific service policies
Haircut Now may provide booking technology directly or through integrated technology providers.
An appointment appearing in Haircut Now does not make Haircut Now the provider of the professional service.
5.2 Booking Fees, Deposits, and Service Payments
Depending on the booking method, service, provider, or product, a transaction may involve:
No advance payment
A booking deposit
A service fee
A referral or platform fee
Full advance payment
Payment directly to the professional or shop
Applicable charges will be presented through the relevant booking or purchase flow when required.
A payment collected by Haircut Now does not necessarily constitute full payment for the professional service.
Any remaining amount owed to the professional or shop is the responsibility of the client.
Haircut Now is not responsible for payment arrangements conducted independently between clients and service providers outside the Services.
5.3 Cancellations, No-Shows, and Booking Refunds
Cancellation and refund conditions may vary depending on the product, professional, shop, booking method, deposit arrangement, or promotional offer.
The applicable cancellation terms presented during the booking process or by the participating business govern the transaction.
Where Haircut Now directly establishes a cancellation or deposit policy for a particular service, that policy will be disclosed during the applicable transaction.
Professional service complaints, dissatisfaction with a haircut or other service, or requests for refunds relating to service quality generally must be resolved with the professional or business that provided the service.
Haircut Now may assist with communication but does not guarantee resolution.
5.4 Same-Day Requests
Haircut Now may provide technology allowing clients to request same-day services from eligible professionals.
Submitting a Same-Day request does not guarantee:
Acceptance
A particular barber
A particular shop
A particular appointment time
A particular price unless confirmed
Successful completion of the service
Participating professionals are responsible for keeping their availability reasonably current.
Certain providers, service types, business models, or locations may not be eligible for Same-Day requests.
Haircut Now may establish eligibility requirements, service areas, request rules, or participation standards for Same-Day functionality.
Any applicable Haircut Now platform or referral fee for participating professionals will be disclosed through the relevant program or account.
5.5 Client Conduct
Clients must behave lawfully and respectfully when interacting with professionals and shops.
Haircut Now may restrict users who engage in:
Harassment
Threats
Violence
Fraud
Discrimination prohibited by law
Repeated intentional no-shows
Payment abuse
False reviews
Other serious misconduct
6. Walk-In Manager
6.1 Walk-In Manager Services
Walk-In Manager provides software to participating shops to manage walk-in customers and staff availability.
Features may include:
Customer check-in
Queue management
Barber availability
Customer assignment
Round-robin distribution
Barber acceptance or pass actions
Staff status
Activity records
Notifications
Manager controls
Related operational features
Haircut Now does not employ the shop’s workers and does not determine how the shop manages employment, compensation, commissions, scheduling, breaks, or workplace policies.
The shop remains responsible for its operation and for determining which employees, contractors, renters, or other personnel may participate.
6.2 Walk-In Queue and Assignment
Walk-In Manager is intended to assist shops with managing customer flow.
Queue placement, estimated waiting time, assignment, and availability may change due to:
Barber availability
Customer preferences
Barber acceptance or rejection
Shop actions
Manager overrides
Technical conditions
Operational circumstances
Haircut Now does not guarantee that:
A particular barber will accept a walk-in
Customers will be served in a particular amount of time
A particular order will always be maintained
Every notification will be delivered immediately
A shop will continuously have participating staff available
The shop is responsible for supervising its own customer service and queue operations.
6.3 Location-Based Staff Check-In
Some Walk-In Manager functionality may use device location to support staff or barber check-in.
Users must not attempt to:
Falsify location
Spoof GPS or location information
Check in another person without authorization
Circumvent location controls
Location verification is a technology tool and is not a guarantee that an individual is physically present at a particular location at every moment after check-in.
Shop owners remain responsible for their own attendance and staffing policies.
7. Booth Rental Manager
7.1 Booth Rental Manager Services
Booth Rental Manager provides software that allows businesses and renters to record and manage rental information.
Features may include:
Rent schedules
Balances
Payments
Partial payments
Credits
Adjustments
Late fees
Payment history
Rent reminders
Renter records
Manager records
Statements
Related administrative features
Haircut Now is not:
The landlord
The shop owner
The tenant
The renter
A property manager
A debt collector acting on behalf of the shop merely by providing the software
A party to the rental agreement
7.2 Booth Rental Records
Users are responsible for ensuring that information entered into Booth Rental Manager is accurate.
Recording a payment in Booth Rental Manager does not necessarily mean that Haircut Now processed or received the payment.
Payments may have been made independently through:
Cash
Payment applications
Bank transfers
Point-of-sale systems
Checks
Credits
Other methods
Shop owners and renters are responsible for resolving disagreements concerning:
Amount owed
Payment received
Late fees
Credits
Rental terms
Move-in arrangements
Security deposits
Rent increases
Termination
Other rental matters
Haircut Now’s records reflect data entered into the system and should not be considered an independent legal determination of an amount owed.
7.3 Booth Rental Disclaimer
Booth Rental Manager is an administrative software product.
Haircut Now does not provide legal advice concerning:
Independent-contractor classification
Employment classification
Lease agreements
Booth-rental agreements
Late fees
Evictions
Collections
Tax treatment
Rental law
Users are responsible for establishing legally compliant rental arrangements.
8. Subscriptions, Trials, and Payments
8.1 Subscriptions
Some Haircut Now products require a paid subscription.
Subscriptions may be offered:
Monthly
Annually
Through a promotional period
Through a free trial
As part of a bundle
Under another billing arrangement displayed at purchase
Unless expressly stated otherwise, recurring subscriptions automatically renew until canceled.
By purchasing a recurring subscription, you authorize Haircut Now and its payment processor to charge the payment method associated with your account for recurring subscription charges.
8.2 Free Trials
Haircut Now may offer free trials for eligible products.
Trial terms may vary by product.
Unless otherwise stated during enrollment:
A valid payment method may be required
Trial access is temporary
A trial may convert automatically to a paid subscription at the end of the trial
The payment method on file may be charged unless cancellation occurs before conversion
Eligibility may be limited to new customers or accounts that have not previously used the applicable trial
Haircut Now may prevent repeated or abusive use of free trials.
8.3 Automatic Renewal
Recurring subscriptions renew automatically unless canceled.
The billing cycle displayed when you subscribe controls the renewal frequency.
You authorize recurring charges until cancellation becomes effective.
Haircut Now will provide renewal or automatic-renewal notices when required by applicable law.
You are responsible for maintaining a valid payment method.
8.4 Canceling a Subscription
Subscribers may cancel through an available account or billing interface or by using another cancellation method provided by Haircut Now.
Unless otherwise stated:
Cancellation stops future renewal
Service continues through the end of the already-paid billing period
Cancellation does not retroactively cancel an already completed charge
No prorated credit is issued for unused time
Deleting an application from a device does not automatically cancel a subscription.
If a subscription was purchased through a third-party application store, cancellation may need to be completed through that store.
8.5 Refunds
Except where required by law or expressly stated in a specific offer:
Subscription payments are non-refundable once charged.
Haircut Now generally does not provide prorated refunds for:
Monthly subscriptions
Annual subscriptions
Partially used billing periods
Failure to use purchased features
Removal of an application from a device
Cancellation after a renewal charge has occurred
If Haircut Now makes a billing error, contact support so that the transaction can be reviewed.
Purchases processed through an application store may also be subject to that store’s refund rules.
8.6 Pricing Changes
Haircut Now may change:
Subscription prices
Product prices
Platform fees
Referral fees
Feature availability
Product packaging
Changes to recurring subscription prices will apply prospectively and will be communicated as required by applicable law.
Users may cancel before a future renewal if they do not wish to continue at the new price.
8.7 Product Bundles
Haircut Now may bundle multiple products or services under a single subscription.
A bundle may provide access to features that would otherwise be sold separately.
Canceling or downgrading a bundle may cause access to some or all bundled products to end.
A user switching between products or plans may receive different entitlements, billing dates, or feature access.
Haircut Now may modify the composition of future plans or bundles, subject to applicable subscription requirements.
8.8 Promotions, Coupons, and Discounts
Haircut Now may offer:
Coupons
Promotional rates
Free periods
Early-adopter programs
Complimentary subscriptions
Referral promotions
Bundle discounts

Unless otherwise stated, promotions:
Have no cash value
Cannot be transferred
May have eligibility requirements
May expire
May be limited to one use per account or customer
May not be combined with other promotions
Haircut Now may reject or revoke promotions obtained through fraud, abuse, duplicate accounts, or manipulation of eligibility requirements.
8.9 Payment Processing
Haircut Now may use third-party payment processors such as Stripe, PayPal, application stores, or other providers.
By submitting payment information, you authorize the applicable processor to charge the selected payment method for authorized purchases.
Payment processing may be subject to separate processor terms.
Haircut Now generally does not store complete payment-card information.
Haircut Now is not responsible for outages or failures originating solely within an independent payment processor.
8.10 Failed Payments
If payment fails, Haircut Now or its payment processor may attempt to process the payment again as permitted by applicable rules.
Failure to pay may result in:
Suspension
Restricted functionality
Downgrade
Removal of paid features
Expiration of a subscription
Suspension of a listing
Termination of the applicable Service
Haircut Now is not required to continue paid service when required payment has not been received.
8.11 Chargebacks and Payment Disputes
If you believe a Haircut Now charge is incorrect, contact:
before initiating a payment dispute when practical.
Users may exercise lawful payment-dispute rights.
Fraudulent, abusive, or bad-faith chargebacks may result in:
Account restriction
Subscription suspension
Removal of paid benefits
Account termination
A payment dispute does not eliminate valid payment obligations.
8.12 Taxes
Users are responsible for taxes applicable to their own business activities, professional services, rental relationships, or earnings.
Haircut Now may collect taxes on Haircut Now products where required by law.
Independent professionals, shops, renters, and vendors are responsible for determining their own:
Income taxes
Employment taxes
Sales taxes
Occupancy or rental taxes
Business taxes
Licensing fees
Other obligations
Haircut Now does not provide tax advice.
9. Content, Reviews, and Platform Use
9.1 Reviews and Ratings
Eligible users may be able to submit ratings or reviews.
Reviews must reflect genuine experiences and may not contain:
Knowingly false statements
Threats
Harassment
Hate speech
Illegal content
Personal information unrelated to the review
Spam
Commercial solicitation
Content submitted in exchange for prohibited compensation
Haircut Now may moderate, investigate, decline to publish, or remove reviews.
Haircut Now does not guarantee the accuracy of every review and does not independently verify every statement submitted by users.
9.2 User Content
“User Content” includes content submitted to Haircut Now by users, such as:
Photographs
Logos
Profile information
Business descriptions
Portfolio images
Reviews
Social links
Service descriptions
Messages
Comments
Other materials
You retain ownership of your User Content.
By submitting User Content, you grant Haircut Now a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and otherwise use that content as reasonably necessary to:
Operate the Services
Display your listing or profile
Promote your public listing or Haircut Now Services
Provide technical functionality
Improve the Services
This license ends when the content is deleted from the Services, except where:
Continued retention is legally required
Copies remain in backups for a reasonable period
Another user lawfully retained content provided to them
The content has already been used in materials created with your authorization
You represent that you have the rights necessary to submit your User Content.
9.3 Prohibited Content
Users may not upload, publish, or transmit content that:
Violates law
Infringes intellectual property rights
Is fraudulent or deceptive
Contains malware
Facilitates unauthorized access
Contains unlawful threats
Promotes illegal activity
Is defamatory
Is unlawfully discriminatory
Constitutes harassment
Exploits minors
Violates another person’s privacy
Otherwise materially interferes with the Services
9.4 Acceptable Use
Users may not:
Attempt unauthorized access to Haircut Now systems
Scrape the platform in violation of applicable law or technical restrictions
Circumvent subscriptions or access controls
Manipulate rankings, reviews, queues, assignments, or availability
Create fraudulent accounts
Impersonate another person or business
Use automated systems to abuse the Services
Introduce viruses or malicious code
Interfere with platform operation
Reverse engineer protected software except where law expressly permits
Use Haircut Now to conduct unlawful activity
Help another person violate these Terms
9.5 Customer and Business Data
Businesses using Haircut Now may receive customer information necessary to provide requested services.
Businesses must use customer information lawfully and only for legitimate business purposes.
Users may not:
Sell Haircut Now customer information obtained through the Services
Use it for unlawful spam
Harass customers
Publish confidential customer information
Use the Services to obtain information for fraudulent purposes
Businesses remain responsible for their own compliance with applicable privacy and marketing laws when independently contacting their customers.
10. Communications
10.1 Service Communications
By creating an account or using the Services, you agree that Haircut Now may send transactional communications relating to:
Account access
Verification
Appointments
Same-Day requests
Walk-ins
Rental activity
Payments
Subscriptions
Trials
Security
Product operation
Other service-related matters
Promotional communications are governed by applicable law and the choices described in our Privacy Policy.
10.2 Text Messages
Where you provide appropriate consent, Haircut Now may send SMS or text messages.
Message and data rates may apply.
Message frequency may vary.
Where supported, reply:
STOP to opt out of applicable SMS messages.
HELP for assistance.
Consent to promotional text messages is not a condition of purchasing Haircut Now Services.
11. Third-Party Services and Mobile App Stores
11.1 Third-Party Services
Haircut Now may integrate with or link to third-party services, including:
Payment processors
Booking systems
Maps
Authentication services
Social networks
Application stores
Cloud platforms
Messaging providers
Analytics providers
Other technology services
Haircut Now does not control independent third-party services.
Your use of those services may be subject to separate terms and privacy policies.
11.2 Apple App Store and Google Play
Haircut Now mobile applications may be distributed through third-party application stores.
Application-store operators are not responsible for providing Haircut Now Services unless their own terms expressly state otherwise.
Purchases, subscriptions, cancellations, or refunds processed through an application store may be governed by the applicable store’s rules.
Users must also comply with applicable application-store terms.
12. Platform Availability and Changes

Combine products

Change eligibility

Discontinue a Service
We will comply with applicable law regarding material changes affecting paid subscriptions.
Haircut Now does not guarantee that any particular feature will remain available indefinitely.
12.2 Beta, Test, and Early-Access Features
Haircut Now may provide beta, preview, pilot, or early-access functionality.
Such features may:

Contain errors
Be incomplete
Be withdrawn
Have limited support
Operate differently from production features
Unless stated otherwise, beta or test features are provided for evaluation and are not guaranteed to become permanent Services.
12.3 Service Availability
We aim to maintain reliable Services, but we do not guarantee uninterrupted availability.
Services may temporarily become unavailable because of:
Maintenance
Software updates
Hosting problems
Internet outages
Payment providers
Cloud providers
Mobile carriers
App stores
Third-party integrations
Security incidents
Technical failures
Circumstances beyond our reasonable control
13. Intellectual Property

Haircut Now and its licensors own the intellectual property associated with the Services, including:

Application interfaces
Source code
Branding
Logos
Designs
Databases

Other proprietary materials
These Terms do not transfer ownership of Haircut Now intellectual property to users.
Subject to these Terms, Haircut Now grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purposes.
13.2 Feedback
If you provide suggestions, ideas, feature requests, or other feedback about Haircut Now, you authorize Haircut Now to use that feedback without restriction or compensation.
This does not transfer ownership of your unrelated intellectual property or confidential business information.
13.3 Copyright Complaints
Haircut Now respects intellectual property rights.
If you believe content on Haircut Now infringes your copyright, contact:

14. Suspension and Termination
14.1 Account Suspension and Termination
Haircut Now may suspend, restrict, or terminate accounts when reasonably necessary because of:
Material violation of these Terms
Fraud
Abuse
Security concerns
Unauthorized access
Nonpayment
Legal requirements
Repeated misuse
Threats to other users
Conduct materially harmful to the Services
Where appropriate, Haircut Now may limit enforcement to the affected product rather than the entire account.
Haircut Now may immediately restrict access when necessary to protect users, systems, or data.
14.2 Effect of Termination
When an account or Service ends:
Access to applicable paid features may stop

15.1 No Guarantee of Business Results
Haircut Now provides software, marketplace exposure, operational tools, and business technology.
We do not guarantee:
New clients
Revenue
Profit
Appointment volume
Walk-in volume
Search rankings
Customer retention
Successful booth-rental collection
Staff performance
Business growth
Any particular financial outcome
Business decisions remain the responsibility of the user.
15.2 Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
HAIRCUT NOW DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
UNINTERRUPTED OR ERROR-FREE OPERATION
Nothing in these Terms excludes warranties that cannot legally be excluded.
16. Liability and Indemnification
16.1 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HAIRCUT NOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES.
This includes, where permitted by law, losses arising from:
Lost profits
Lost revenue
Lost business opportunities
Missed appointments
No-shows
Professional-service disputes
Rental disputes
Lost data
Third-party conduct
Unauthorized account activity not caused by Haircut Now
Third-party service failures
Reliance on user-submitted information
TO THE FULLEST EXTENT PERMITTED BY LAW, HAIRCUT NOW’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID DIRECTLY TO HAIRCUT NOW DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100.
Some jurisdictions do not permit certain limitations of liability, so some limitations may not apply to you.
16.2 Indemnification
To the extent permitted by law, business users, professionals, shops, vendors, and other commercial users agree to indemnify and hold harmless Haircut Now and its officers, directors, employees, and affiliates from third-party claims arising from:
Their professional services
Their business operations
Their User Content
Their violation of law
Their breach of these Terms
Their rental relationships
Their employment or contractor relationships
Their misuse of customer information
Their infringement of third-party rights
This obligation does not apply to the extent a claim results from Haircut Now’s own unlawful conduct.
17. Disputes
17.1 Disputes Between Users
Haircut Now is not a party to disputes between:
Clients and professionals
Professionals and shops
Renters and shop owners
Employees and employers
Independent contractors and businesses
Vendors and buyers
Other users
Haircut Now may provide reasonable assistance or communication tools but has no obligation to adjudicate private disputes.
Users remain responsible for resolving their own contractual and service disagreements.
17.2 Informal Dispute Resolution With Haircut Now
Before initiating formal proceedings against Haircut Now, you agree to first attempt to resolve the dispute informally by contacting:

Your name
Relevant account
Nature of the dispute
Requested resolution
The parties will attempt in good faith to resolve the dispute before proceeding to arbitration or another permitted forum.
17.3 Binding Arbitration
Except for matters that qualify for small claims court or claims seeking appropriate injunctive relief concerning intellectual property or unauthorized system access, disputes arising out of or relating to these Terms or the Services will be resolved by individual binding arbitration to the extent permitted by law.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Arbitration will be conducted by a nationally recognized arbitration provider under its applicable consumer or commercial rules, depending on the nature of the dispute.
The arbitrator may award the same individual remedies that would be available in court to the extent permitted by law.
Nothing in this section prevents either party from bringing an eligible individual matter in small claims court.
17.4 Class Action and Jury Trial Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AND HAIRCUT NOW AGREE THAT DISPUTES WILL BE RESOLVED INDIVIDUALLY.
Neither party will seek to have a dispute heard as:
A class action
A collective action
A representative action
A private-attorney-general action
except where such waiver is prohibited by applicable law.
TO THE EXTENT A CLAIM IS SUBJECT TO ARBITRATION, BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL.
18. Governing Terms
18.1 Governing Law
Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
The Federal Arbitration Act governs arbitration provisions.
18.2 Local Law
Users are responsible for complying with laws applicable where they live, operate a business, provide professional services, rent space, or use the Services.
If a provision of these Terms conflicts with a law that cannot contractually be waived, the applicable law controls to the extent of the conflict.
18.3 Changes to These Terms
Haircut Now may update these Terms to reflect:
New products
New functionality
Business changes
Technology changes
Legal requirements
Changes to our practices
We will update the Effective Date when the Terms change.
When legally required, we will provide additional notice of material changes.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18.4 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect unless the invalid provision is essential to the overall agreement.
An unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted.
18.5 No Waiver
Failure by Haircut Now to enforce a provision of these Terms does not waive our right to enforce it later.
18.6 Assignment
You may not assign your rights or obligations under these Terms without Haircut Now’s written permission.
Haircut Now may assign these Terms in connection with:
A merger
Acquisition
Corporate restructuring
Financing
Sale of assets
Transfer of the applicable business
subject to applicable law.
18.7 Entire Agreement
These Terms, together with the Haircut Now Privacy Policy and any additional terms expressly presented for a specific product or transaction, constitute the agreement between you and Haircut Now concerning the Services.
If product-specific terms conflict with these general Terms, the product-specific terms control for that product to the extent of the conflict.
