TERMS OF SERVICE
Effective Date: February 27, 2025
Governing Law: State of Delaware
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Client,” “Vendor,” “Barber,” or “Listing Owner”) and Haircut Now (“Company,” “we,” “us,” or “our”).
By accessing or using the website, mobile applications, directory, ecommerce marketplace, or related services (collectively, the “Platform”), you agree to these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use.
1. Platform Structure & Role of Haircut Now
Haircut Now operates a technology platform that includes:
A same-day barber booking marketplace
A public barber and business directory
A multi-vendor ecommerce marketplace powered by WooCommerce and MultiVendorX
Haircut Now is a neutral technology intermediary.
We do not:
• Provide barber services
• Manufacture, own, warehouse, or control vendor products
• Employ barbers or vendors
• Guarantee business performance, traffic, bookings, or sales
All services and products are provided by independent third parties.
2. Independent Contractor Status
All Barbers, product vendors, barber supply stores, beauty supply stores, and other sellers (“Vendors”) are independent contractors.
Nothing in these Terms creates:
• Employment
• Agency
• Partnership
• Joint venture
• Franchise relationship
Vendors are solely responsible for:
• Licensing and regulatory compliance
• Tax obligations
• Product safety compliance
• Fulfillment and shipping
• Warranties and representations
• Customer communication
Haircut Now disclaims all responsibility for Vendor conduct, products, or services.
3. Haircut Booking Marketplace Terms
3.1 Deposits
Clients pay a deposit through the Platform.
• The deposit is applied toward the total service cost
• Remaining payment is made directly to the Barber
• Haircut Now does not control or guarantee off-platform payments
Haircut Now retains a referral fee from deposits as disclosed.
3.2 Cancellations
Clients may cancel at least one (1) hour before the scheduled appointment for a deposit refund.
Late cancellations and no-shows result in forfeiture.
Haircut Now is not responsible for disputes regarding service quality.
4. Multi-Vendor Ecommerce Marketplace
Haircut Now facilitates online sales between Customers and independent Vendors.
Unless explicitly stated otherwise:
• Vendors are the seller of record for their products
• Vendors set product details and fulfillment terms
• Vendors are responsible for shipping and inventory
Haircut Now provides payment facilitation and marketplace infrastructure only.
5. Refund & Return Policy – Marketplace Store
5.1 Hardware Products
Eligible for return within seven (7) days of confirmed delivery if:
• Unused
• In original condition
• Returned in original packaging
Haircut Now reserves sole discretion to approve or deny returns.
5.2 Consumables & Hair Products
Hair products, consumables, and hygiene-sensitive items are:
FINAL SALE
NON-RETURNABLE
Except in cases of verified damage or defect upon delivery.
5.3 Refund Requests
Customers must submit refund requests within seven (7) days of delivery where eligible.
Failure to submit within the stated period constitutes waiver of refund rights.
6. Commission, Fees & Financial Controls
Haircut Now may collect:
• Referral fees
• Sales commissions
• Payment gateway cost recovery fees
• Subscription fees
Commission rates may be modified with advance notice.
Haircut Now may deduct:
• Refund amounts
• Chargebacks
• Processing fees
• Fraud-related losses
From Vendor balances.
7. Disbursement & Withholding Rights
Vendor payouts are subject to:
• Order completion
• Expiration of refund claim window
• Fraud review
• Chargeback exposure
• Payment processor reserve requirements
Haircut Now reserves the right to:
• Delay payouts
• Impose rolling reserves
• Set withdrawal thresholds
• Reverse prior disbursements
Vendor earnings are not considered final until disbursed and cleared.
8. Chargebacks & Disputes
If a chargeback, payment dispute, or fraud claim occurs:
• Vendor may be held financially responsible
• Haircut Now may recover losses from Vendor balance
• Haircut Now may suspend or terminate Vendor access
Excessive disputes may result in permanent removal.
Users agree to contact support prior to initiating chargebacks.
Fraudulent chargebacks may be reported to financial institutions.
9. Payment Processing
Payments are processed via Stripe and/or PayPal.
By making a payment, you agree to:
• Stripe’s Terms of Service
• PayPal’s User Agreement
Haircut Now does not store full payment credentials and is not liable for processor outages or security incidents.
10. Directory Listings
The Directory is an advertising and discovery platform.
Haircut Now does not guarantee:
• Traffic
• Search rankings
• Leads
• Revenue
Listing owners are solely responsible for:
• Content accuracy
• Legal compliance
• Business representations
Haircut Now retains editorial discretion.
11. Reviews & Content Moderation
Users may post reviews and content.
You agree not to post:
• Defamatory statements
• False claims
• Illegal material
Haircut Now may remove content at its sole discretion.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Haircut Now shall not be liable for:
• Personal injury
• Product defects
• Barber service outcomes
• Vendor misconduct
• Financial losses
• Lost profits
• Business interruption
• Chargebacks
• Shipping delays
Platform use is at your sole risk.
13. Indemnification
You agree to indemnify, defend, and hold harmless Haircut Now from any claims, losses, damages, liabilities, or legal expenses arising from:
• Your use of the Platform
• Your services or products
• Your violation of these Terms
• Your violation of law
This includes attorney’s fees.
14. Arbitration & Class Action Waiver
All disputes shall be resolved by binding arbitration in Delaware.
You waive the right to:
• Jury trial
• Class action participation
15. Termination
Haircut Now may suspend or terminate accounts at any time, with or without notice, for violations or risk management purposes.
No refunds are owed upon termination for cause.
16. SMS Messaging Terms
Haircut Now may offer SMS notifications, alerts, appointment-related messages, listing updates, account notifications, and occasional marketing messages through the Haircut Now SMS program.
By providing your mobile number and opting in, you agree to receive SMS messages from Haircut Now. Message frequency varies.
You can cancel the SMS service at any time. Simply text “STOP” to unsubscribe. After you send “STOP,” we will confirm your unsubscribe status by SMS. After this confirmation, you will no longer receive SMS messages from us. To rejoin, you may opt in again through the same process you used initially.
If you experience issues with the messaging program, reply “HELP” for assistance or contact us directly at support@haircutnow.com.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for messages sent to you from us and to us from you. For questions about your text or data plan, contact your wireless provider.

17. Modification of Terms
We may update these Terms at any time.
Continued use constitutes acceptance.
18. Governing Law
These Terms are governed by the laws of the State of Delaware.
